Terms and Conditions

for heartbeat by Julia

1. Scope

These General Terms and Conditions (GTC) apply to all contracts between "Herzton by Julia" (hereinafter: Provider) and customers who book services in the field of musical performances (e.g., weddings, baptisms, funerals, other events). Any differing terms and conditions of the customer are not recognized unless agreed upon in writing.

2. Scope of services

The provider offers musical services (live music, possibly including moderation or accompaniment) by individual arrangement. The exact scope of services is detailed in the respective booking confirmation.

3. Conclusion of the contract

A contract is formed as soon as a booking has been confirmed in writing (via email or online booking system). Verbal agreements are only binding if they are confirmed in writing.

4. Prices & Payment Terms
  • All prices are agreed upon individually in advance.

  • Unless otherwise specified, invoices are payable without deduction no later than 7 days after receipt.

  • Cancellations are subject to the cancellation policy listed below.

5. Withdrawal & Cancellation
  • Cancellation up to 30 days before the agreed date: free of charge.

  • Cancellation up to 14 days before the appointment: 50% of the agreed fee.

  • Cancellation within 7 days of the appointment: 100% of the fee.

  • In case of illness or force majeure on the part of the provider, a replacement date will be offered or payments already made will be fully refunded.

6. Customer Obligations

The clients are obliged to provide suitable conditions on site (e.g. electricity connection, weatherproof performance area for outdoor events, agreement with the location).

7. Copyrights & Recordings
  • Musical performances are protected by copyright.

  • Audio and video recordings are only permitted after prior agreement.

  • Publication of recordings (e.g. on social media) requires the consent of the provider.

8. Liability

The provider is only liable for damages resulting from intentional or grossly negligent conduct. Any further liability is excluded.

9. Data protection

Personal data will be used exclusively for contract processing and will not be passed on to third parties unless there is a legal obligation to do so.

10. Final Provisions

Austrian law applies. The place of jurisdiction is – to the extent permitted – Leibnitz. Should individual provisions of these terms and conditions be invalid, the validity of the remaining provisions shall remain unaffected.
